What is the Information Act?

The Information Act is designed to promote the free flow of government information and protection of personal information.

Its primary purpose is to encourage the view within government that access to information is of a positive benefit and those public sector organisations should adopt a culture of readily providing the public with access to government information.

Exceptions for non-disclosure include matters contrary to public interest. Under the Act and for the first time in Australia, the related issues of Freedom of Information (FOI), Privacy and Records and Archives management are brought together.

The Act protects the privacy of personal information held by public sector organisations such as Tourism NT and Territory Discoveries, in accordance with Information Privacy Principles scheduled in the Act. These principles set standards for the manner in which personal information is collected and handled.

The Act Has Four Main Components

- A right of access to government information, including personal information except where an exemption applies
- The appointment of an Information Commissioner
- Effective and responsible record keeping and records management
- The protection of personal information in the public sector by applying IPPs

When Does The Information Act Commence?

The Act received assent on November 8 November 2002 and is to commence on 1 July 2003.
